...... Her approach became the effective majority when in Webster v. Reproductive Health Services, 492 U.S. 490 ( 1989), the Court upheld restrictions on access to abortion but did not overrule Roe v. Wade. O'Connor supplied the crucial fifth vote but did so in a concurring opinion employing her undue burden approach. She also made clear that the state can "directly promote its interest in potential life when viability is possible." (Friedman & Israel, 1997, p. 1801)
In her ruling she clearly demonstrated her stand to resolve to allow the states jurisprudence over state constitutional decisions. Though she refused outright to stake a stand directly against Roe she still allowed at least a bit of her conservative stance to shine through in her decision. She was admonished by some for this choice and applauded by others.
