Background: Discretion is the exercising of choice. Usually discretion involves a conscious, purposeful decision to disregard a directive, protocol, or normative behavior in favor of some alternative recourse deemed to be more appropriate to the current circumstance or condition. Discretion is fraught with risk, however. Deviation from direction may be construed as disrespect, disobedience, or worse. Sometimes this involves the generalization of findings from a sample to a population. For example, would the observations made in the Stanford Prison experiment be the same if the subjects were middle aged females from New York rather than college students in California?

Merging Probabtion and Parole in

My research paper should be about the benefits of merging Parole and Probation in New Jersey.. Meaning, how can we improve the enforcement of court orders for Probation Officers if they had arresting powers. Since Probation Officers do not have arresting powers, probationers consider Probation Officers more like social worker, instead of a law enforcement officer like a Parole Officer. Probationers don't pay their fines, don't follow the court orders (fail to comply with court orders). The goal should be that by giving Probation Officers arresting powers like parole officers, we would have the probationers comply with what demanded from them. The US government uses this model. U.S. Probation Officers use this system in which the officer does both jobs and they are successful. A U.S. Probation Officer is a parole/probation officer. In the federal level they are considered law enforcement and in the state level particularly in NJ they are Court Officers. In New Jersey, Parole Officers perform supervision after a defendant has been released from prison, and a Probation Officer performs supervision as a court alternative to avoid sending someone to prison. They both perform monitoring jobs, the difference is the before and after part and both agencies belonging to different branches of the criminal justice system. Probation Officers belong to the Judicial brach of the state while Parole Officers belong to the Executive branch of the system.

Bob aged 17 has been labeled as a criminal or delinquent by his family as well as his school authorities and the court, for a crime he committed in school by stealing money from his teacher's purse. It has stigmatized him leading to a negative self-image that he has developed for himself. If Bob's case is handled informally and an immediate effort is made to get him out of the formal justice system, it will have a far more positive outcome. Based on the statement answer the following questions.

?Based on your research on labeling theory, is this the best thing for delinquents? Why? Provide scholarly citations and references to support your reasons.

?Is the social labeling theory flawless? If so, why? Justify your answer with examples and reasoning.

Keeping in mind that white collar crime criminals often receive much more lenient sentences than those judged guilty of street-level offenses, answer the following question.

?Using the relevant government reports, how are the current enforcement of laws dealing with white collar crimes (like insider trading, price fixing, false advertising, and environmental pollution) and the enforcement concerning street-level property crimes (theft, burglary, gang-related, etc.) related to the labeling theory and social conflict theory?

Deviance doesn't necessarily mean law violating. It's a departure from the norms of a society. The definition of what is considered delinquent, criminal, or deviant today is different than what it was in the past. Since labeling theory involves society's reaction and the consequences of that reaction:
