Ethics terminology to include

equality/justice

The principle or idea that people should be treated equally. In nursing, it relates to fair, equitable, and appropriate treatment for all clients.

Beneficence

The principle that health care should be good, or beneficial. It also requires nurses to advocate for, protect, and prevent harm to clients.

commitment/trust

The idea of a professional commitment to care for a patient and uphold professional standards of care. In health care, this is often an unspoken matter of trust between client and nurse.


confidentiality

The principle of holding certain matters private or secret. In law, lawyers, clergy, doctors, and others cannot be required to divulge private or confidential matters. The concept is being extended to nursing and other fields as well.


consequentialism

A principle concerned with the end result or consequences. In health care, it implies acceptance of responsibility for the consequences to the patient of one's nursing care activities.


duty/veracity/fidelity

The principle of abiding by a system of rules or duty. It refers to the nurses duty to tell the truth and the clients right to know about their diagnosis, treatment, prognosis, etc. It also addresses the nurses duty to be faithful and loyal to the client.

CASE PRESENTATION

Background information:

Mr. Z is a visiting professor of biophysics at a large university medical center. The Z family came to the United States two years ago and will be in this country for five years. Family members include the doctor; his wife, Mrs. Z; their two children, who are four and seven years old; and Mr. Zs mother.

The family has adopted the traditions of a prominent culture in their country of origin, where the husband is conventionally the primary decision maker and the husbands mother is in charge of the household, determining how it is organized. Mrs. Z accepts her mother-in-laws decisions related to the household and child-rearing practices.

Ethical situation:

Mrs. Z discovers a lump in her right breast. She tells her mother-in-law, who then shares the information with her son, Mr. Z. Mrs. Z, her husband, and her mother-in-law go together to a female physician, Dr. F.

Mrs. Z is examined without her family in the room. This is acceptable to her culture, since only females are present. She has a mammogram. She privately tells the physician and attending nurse that she does not want her husband or mother-in-law to know the outcomes of the examination and test.

She is given another appointment after the results of the mammogram are available. Dr. F and the nurse explain that she needs a biopsy. The mammogram showed a suspicious area, and a biopsy would help Dr. F establish a diagnosis. Mrs. Z chooses to have a biopsy without consulting anyone in her family. She again states she does not want her family to know more about her situation.

The culture is generally family members would go with the person receiving the care but since Mrs. Z is being seen by a female physician, he would not need to be in the room.

When Mrs. Z comes into the waiting room, her family asks her questions about what was done. She tells them that nothing was done, that the appointment was just a follow-up. Two weeks later, Dr. F calls Mrs. Z to tell her that the biopsy was positive and that Mrs. Z needs additional treatment. Mrs. Z does not tell her family. She is afraid of having chemotherapy, a mastectomy, or other treatment.

When Mr. Z sees the medical bills, he questions his wife about the procedures. She continues to say nothing is wrong but appears unhappy. The nurse calls Mrs. Z to see if she will come into the office so treatment options can be discussed. Mrs. Z states that she will not seek additional treatment and does not want any information shared with her family.

Her husband is concerned. He talks with one of his colleagues, Dr. J, who is a medical doctor, and asks Dr. J to find out what is happening with Mrs. Z. Dr. J calls the office and asks the nurse to provide him with electronic access to Mrs. Zs records. The nurse states she will talk with Dr. F about his request.

Dr. F and the nurse discuss the situation related to patient confidentiality. They use a decision-making process and review the limits of confidentiality and the good or harm in respecting Mrs. Zs request not to share information. They base their decision making on their commitment to professional standards and their desire to ensure that Mrs. Z receives the best care possible.

A Framework for Thinking Ethically
This document is designed as an introduction to thinking ethically. We all have an image of our better selves-of how we are when we act ethically or are "at our best." We probably also have an image of what an ethical community, an ethical business, an ethical government, or an ethical society should be. Ethics really has to do with all these levels-acting ethically as individuals, creating ethical organizations and governments, and making our society as a whole ethical in the way it treats everyone.
What is Ethics?
Simply stated, ethics refers to standards of behavior that tell us how human beings ought to act in the many situations in which they find themselves-as friends, parents, children, citizens, businesspeople, teachers, professionals, and so on.
It is helpful to identify what ethics is not:
? Ethics is not the same as feelings. Feelings provide important information for our ethical choices. Some people have highly developed habits that make them feel bad when they do something wrong, but many people feel good even though they are doing something wrong. And often our feelings will tell us it is uncomfortable to do the right thing if it is hard.
? Ethics is not religion. Many people are not religious, but ethics applies to everyone. Most religions do advocate high ethical standards but sometimes do not address all the types of problems we face.
? Ethics is not following the law. A good system of law does incorporate many ethical standards, but law can deviate from what is ethical. Law can become ethically corrupt, as some totalitarian regimes have made it. Law can be a function of power alone and designed to serve the interests of narrow groups. Law may have a difficult time designing or enforcing standards in some important areas, and may be slow to address new problems.
? Ethics is not following culturally accepted norms. Some cultures are quite ethical, but others become corrupt -or blind to certain ethical concerns (as the United States was to slavery before the Civil War). "When in Rome, do as the Romans do" is not a satisfactory ethical standard.
? Ethics is not science. Social and natural science can provide important data to help us make better ethical choices. But science alone does not tell us what we ought to do. Science may provide an explanation for what humans are like. But ethics provides reasons for how humans ought to act. And just because something is scientifically or technologically possible, it may not be ethical to do it.


Why Identifying Ethical Standards is Hard
There are two fundamental problems in identifying the ethical standards we are to follow:
1. On what do we base our ethical standards?
2. How do those standards get applied to specific situations we face?
If our ethics are not based on feelings, religion, law, accepted social practice, or science, what are they based on? Many philosophers and ethicists have helped us answer this critical question. They have suggested at least five different sources of ethical standards we should use.
Five Sources of Ethical Standards
The Utilitarian Approach
Some ethicists emphasize that the ethical action is the one that provides the most good or does the least harm, or, to put it another way, produces the greatest balance of good over harm. The ethical corporate action, then, is the one that produces the greatest good and does the least harm for all who are affected-customers, employees, shareholders, the community, and the environment. Ethical warfare balances the good achieved in ending terrorism with the harm done to all parties through death, injuries, and destruction. The utilitarian approach deals with consequences; it tries both to increase the good done and to reduce the harm done.
The Rights Approach
Other philosophers and ethicists suggest that the ethical action is the one that best protects and respects the moral rights of those affected. This approach starts from the belief that humans have a dignity based on their human nature per se or on their ability to choose freely what they do with their lives. On the basis of such dignity, they have a right to be treated as ends and not merely as means to other ends. The list of moral rights -including the rights to make one's own choices about what kind of life to lead, to be told the truth, not to be injured, to a degree of privacy, and so on-is widely debated; some now argue that non-humans have rights, too. Also, it is often said that rights imply duties-in particular, the duty to respect others' rights.
The Fairness or Justice Approach
Aristotle and other Greek philosophers have contributed the idea that all equals should be treated equally. Today we use this idea to say that ethical actions treat all human beings equally-or if unequally, then fairly based on some standard that is defensible. We pay people more based on their harder work or the greater amount that they contribute to an organization, and say that is fair. But there is a debate over CEO salaries that are hundreds of times larger than the pay of others; many ask whether the huge disparity is based on a defensible standard or whether it is the result of an imbalance of power and hence is unfair.

The Common Good Approach
The Greek philosophers have also contributed the notion that life in community is a good in itself and our actions should contribute to that life. This approach suggests that the interlocking relationships of society are the basis of ethical reasoning and that respect and compassion for all others-especially the vulnerable-are requirements of such reasoning. This approach also calls attention to the common conditions that are important to the welfare of everyone. This may be a system of laws, effective police and fire departments, health care, a public educational system, or even public recreational areas.
The Virtue Approach
A very ancient approach to ethics is that ethical actions ought to be consistent with certain ideal virtues that provide for the full development of our humanity. These virtues are dispositions and habits that enable us to act according to the highest potential of our character and on behalf of values like truth and beauty. Honesty, courage, compassion, generosity, tolerance, love, fidelity, integrity, fairness, self-control, and prudence are all examples of virtues. Virtue ethics asks of any action, "What kind of person will I become if I do this?" or "Is this action consistent with my acting at my best?"
Putting the Approaches Together
Each of the approaches helps us determine what standards of behavior can be considered ethical. There are still problems to be solved, however.
The first problem is that we may not agree on the content of some of these specific approaches. We may not all agree to the same set of human and civil rights.
We may not agree on what constitutes the common good. We may not even agree on what is a good and what is a harm.
The second problem is that the different approaches may not all answer the question "What is ethical?" in the same way. Nonetheless, each approach gives us important information with which to determine what is ethical in a particular circumstance. And much more often than not, the different approaches do lead to similar answers.
Making Decisions
Making good ethical decisions requires a trained sensitivity to ethical issues and a practiced method for exploring the ethical aspects of a decision and weighing the considerations that should impact our choice of a course of action. Having a method for ethical decision making is absolutely essential. When practiced regularly, the method becomes so familiar that we work through it automatically without consulting the specific steps.

The more novel and difficult the ethical choice we face, the more we need to rely on discussion and dialogue with others about the dilemma. Only by careful exploration of the problem, aided by the insights and different perspectives of others, can we make good ethical choices in such situations.
We have found the following framework for ethical decision making a useful method for exploring ethical dilemmas and identifying ethical courses of action.

Case Study:

As a staff nurse in an intensive care unit, you accompany Dr. K to assess the condition of a patient, Mr. E, currently in the emergency department. The nursing home where Mr. E resides has brought him to the hospital because of lung congestion. The medical notes indicate that Mr. E is a 67-year-old white male with diabetes, high blood pressure, poor vision, and hearing difficulties, and is mildly developmentally delayed.

After assessing Mr. E?s condition, Dr. K determines that Mr. E has pneumonia secondary to aspiration. Mr. E is dyspneic on exertion and is running a fever of 101o F. He has a blood oxygen saturation level (SpO2) of 88% on room air. Dr. K determines that Mr. E will need to be placed on a ventilator and admitted to the intensive care unit. When Dr. K explains the situation Mr. E shakes his head and says, ?Go away! No! No! Take me home.? Knowing that Mr. E is developmentally delayed and hypoxic, Dr. K is concerned that Mr. E does not understand the situation.

Dr. K notes that without the ventilator Mr. E will continue to aspirate and likely die. Dr. K asks you to look at Mr. E?s file to determine whether there is anyone else who might have responsibility for Mr. E. The chart indicates that seven years ago Mr. E checked himself into the local nursing home. When he entered the nursing home a patient advocate helped him fill out an advance directive, which stated Mr. E?s medical wishes. Mr. E clearly indicated that he did not want a ventilator or cardiopulmonary resuscitation. No family member signed the advance directive and it is unclear if any family members were involved. Mr. E has also filled out a medical power of attorney, which states Mr. E wants his younger brother, Mr. Y, to make medical decisions for him in the event he is no longer able to do so.

Dr. K asks you to call the brother and explain the entire situation. You call Mr. Y and tell him his brother is in the hospital with serious pneumonia. You explain that if Mr. E is not treated soon, he will most likely die within a few days. You tell Mr. Y that his brother is refusing the ventilator. You also explain to Mr. Y that his brother?s low oxygen saturation and fever may be preventing him from thinking clearly. Mr. Y asks if he can think about it and let you know the following day. Because Dr. K feels it is an urgent situation and that the decision needs to be made right away, you tell Mr. Y that it cannot wait. You do not mention the advance directive.

Finally Mr. Y agrees to drive to the hospital, see his brother, and make a decision. Immediately after hanging up the phone, Mr. Y decides to call his niece, Ms. H, hoping she might know what to do. His niece does not answer the phone, so he leaves her a message about the situation, stating he would like her advice on what to do.

Ms. H receives the phone message within the hour. She immediately calls Mr. Y back, but he is no longer home. Ms. H calls her boyfriend and asks him to drive her to the hospital. When she gets there, she does not find Mr. Y, but she is directed to the intensive care unit, where you are still on duty. Ms. H arrives with her boyfriend at her side.

You greet Ms. H just as Dr. K walks into the waiting room. Upon hearing who Ms. H is, Dr. K begins to explain Mr. E?s condition. The boyfriend is standing next to Ms. H and there are several other people sitting in the waiting room. Dr. K emphasizes the need for someone to provide consent for the ventilator. He does not mention Mr. E?s advance directive. Ms. H quickly provides verbal consent and tells Dr. K she will talk with her uncle, Mr. Y, and convince him to sign the necessary paperwork since he is the one with the medical power of attorney. Dr. K plans to proceed with the intubation while Ms. H and her boyfriend wait for Mr. Y?s arrival.

You are scheduled to take a dinner break and go to the cafeteria where you sit with three nurses who work on the medical-surgical unit where many ICU patients are transferred. You explain the situation to them and ask them what they think you should do. One nurse says, ?What difference does it make? The guy?s got diabetes, is retarded, and is already in a nursing home.? Another nurse tells you to forget it and says that no one pays attention to HIPAA anyway. A third nurse says there was no such thing as an advance directive when she went to school so she doesn?t know anything about them. You return to the unit to find Mr. E intubated and on a ventilator.

The scenario is about a patient named Mrs. Burgone, she is unable to have a liver transplant because she is over the age of 70 even though she can afford to pay for the surgery.

All these questions are appropriate for ethics, but in class discussion we will focus on clarifying questions and interpretive questions. If you don?t understand a statement, then please ask a question of clarification. If you have one understanding of a statement, but are aware that a statement may be understood in various ways, then please ask an interpretive question about one or more of these meanings. Discussing clarifying and interpretative questions will be most useful for class discussion. This is why students are required to raise three such questions for class discussion, based on the reading assignments, before the end of the course.
Many clarifying or interpretive questions concern words, phrases, or sentences that have some ambiguity. In addition, clarifying or interpretive questions may concern possible relationships between statements, or images, or ideas. A good clarifying or interpretive question expresses both genuine doubt and real interest. For the purpose of class discussion a clarifying or interpretive question that is clear and specific, rather than vague and general, will be most helpful.
A factual question you may have can be transformed into an interpretative question by asking what certain facts mean to others, or to you. Asking if Dominican University has an ethical code of conduct is a factual question. Asking what it means for the University to have or not have such a code is an interpretive question.
An evaluative question can be made into an interpretative question by shifting the inquiry from judgment to meaning. Asking whether or not someone agrees or disagrees with an ethical principle requires an evaluation. Asking why those who support do support such ethical principle requires interpretation.
Interpretative questions may concern meaning for others or for us. We might ask what the ethical presumption, that persons are to be treated as innocent of a crime until proven guilty beyond a reasonable doubt, has meant for us as well as what it has meant for our society. Even if we have never been arrested or charged with a crime, this ethical presumption may nonetheless have considerable meaning for us, as it does for many others.
Finally, we can ask interpretative questions about interpretative questions. We might ask how our knowledge or ignorance, our prejudices and desires, and our culture and time in history shape our "interpretations" of ethical arguments, and the degree to which we "find" or "construct" meaning.
Is our way of inquiring about ethics itself an interpretation? Does our talk about ethics reinforce certain interpretations and obscure others? What are the questions hidden from us by our questions? And what are the meanings we may be missing, because of the meanings we have found or constructed for ourselves?

Your answer to each essay question should be complete and between 200 and 300 words.
