Is Mayor Bloomberg over stepping his bounds when tries to ban large sodas.

The mayor of New York City Michael Bloomberg has come up with a plan of banning large soda and sugary drinks from restaurants as well as other city venues. The proposal of the ban was that it starts on March 12. However, on March 11 the ban was overturned by the State Supreme Court in Manhattan.

This ban was announced last May with the aim of prohibiting restaurants from selling or serving soda in larger containers that are more than 16 ounces, (John Mihovics, 2013). This was to affect the bowling alleys, nightclubs, pizza deliveries as well as its effect was to be realized within local convenient stores.

It is true that Mayor Bloomberg is over stepping his bounds by trying to carry out this unwelcomed news. The State Supreme Court in Manhattan also confirms this when Judge Milton a. Tingling did not agree with the reasons presented before him to support taking of this action. The judge labeled the limits as arbitrary and capricious.

The Mayor whose term is almost done opposes the ruling from the court and says that he is to appeal the decision. He argues that he has to defend his children, and other children, and do whatever is right in order to save lives. This move angered some of the local small businesses as well as seeing the move as stepping ahead of his positional authority.

As a matter of fact this move would make consumers to dig more inside their pocket, thereby incurring larger cost for they have to buy smaller amounts of soda in larger bulk, a move that definitely signifies an increase in terms of cost. Some have supported the move arguing that Bloomberg just wants New Yorkers to be fitter and healthier, however this plan question the degree of power that a mayoral position is allowed to assert over a city.
According to the judge, this proposal is erratic and undeserved, though the court describes it to out of good intention since the mayor holds the health of his people in his mind. Overturned the decision is much welcomed by soda companies. For example, one of the American Beverage Association spokesman describe the decision as a sigh of relief.

Conclusion

Even though many have had sigh of relief, if that will remain with that an ultimate refusal to ban the 16 fluid ounce drinks, or whether Bloomberg and his supporters may manage to change the decision of the court and implement this unfavorable new measures.
