THE TENANTS AGREE

With the careful reading, dating, and signing of this contract, and with receipt of required deposit, Tenants will use the premises for residential purposes only and lease will take effect from June 1, 200* until May, 26, 200* with the proviso of the following conditions:

DEPOSIT

Tenant will provide Landlord with mutually agreed upon deposit. This deposit will cover any damages that ensue to the premises beyond the expected wear and tear. The deposits also proceed to unpaid rent and additional cleaning costs. The Tenants are obligated to cover damages that exceed the cost placed down by the deposit.

RENT

The monthly rate is $____. Tenants are expected to pay the tent at the first, or prior to the first of each month. According to mutual agreement by Landlord and Tenants, the rent for this entire term is $

LATE RENT

Unless previously arranged in writing with Landowner, Tenant is charged a $5.00 fee per day for any outstanding payment in rent that exceeds 10 days past the due date. Persistence in refusal to pay may result in eviction.

CHECKS

Tenant will be charged a $25- fee for bounced checks.

UTILITIES

The Tenant shares exclusive responsibility (including hook-up and security deposit) for electricity, heat, and similar utilities. The Tenant will also pay a monthly $7.50 pay for water and a monthly $7.50 pay for garbage retrieval. The total sum - $15.00 - will be paid on a monthly basis to the landowner. The $7.50 garbage retrieval fee will be charged for the entire 12-month period that the Tenant has leased the apartment, whereas the $7.50 water fee will not be charged during the months of June to August when the apartment remains unoccupied.

The Tenants agree

OCCUPANCY

That only the people (maximum four) who are subjects of this contract will occupy and live in this apartment.

SUBLEASE

That aforesaid subjects will not sublease without prior written agreement from the Landlord. Subleasing will necessitate an additional security deposit to the Landlord.

DAMAGE

To refrain from deliberately damaging walls, ceilings, fixtures, or any other part of the building, which will result in permanent injury to the aforesaid building, and to instantly notify Landlord of malfunction in premise that may result in further costs and damage if left untreated (e.g., plumbing, electrical resources etc.). The Tenant also agrees to use bathroom fan and dehumidifier as means of controlling humidity in the apartment. FAlLURE to DO SO WILL MAKE the TENANTS LIABLE for DAMAGE RESULTING FROM CONSEQUENT HUMIDITY.

WATERBEDS

To refrain from using waterbeds in the apartment due to possibility of leaks and extensive damage.

PETS

Pets are prohibited on premises. Tenant agrees to pay Landlord $50 per month for each month that this agreement has been violated.

REPAIRS

Tenant agrees to allow Landlord access to apartment in the case of, and for the purpose of, investigation of apartment and for prerequisite repairs.

UPKEEP

Tenant refrains from accumulating litter, junk, or waste materials on premises and contracts to maintain all furnishings in the apartment in like condition as when taken. At the end of this contract no additional repairs should be necessary beyond normal wear and tear.

PARKING

A maximum of 2 vehicles are parked on the premises, and these vehicles are moved in the event of snowplowing.

Premises are kept in accordance with government legislation (including police, sanitary, and other regulations).

EVICTION

Eviction occurs to Tenant on the following grounds:

Unpaid rent; conviction of crime in connection with premises; and the aforementioned agreements are violated. In these and similar circumstances, the Landlord and/or representative(s) of the Landlord may evict the Tenant.

LANDLORD AGREES

CONTRACT

That the Tenant(s) signing this contract will be undisturbed in their leasing of the premises provided that they follow aforesaid terms of the agreement

DEPOSIT

To return deposit to Tenants within 30 days following the expiration of their lease, provided that damages and unpaid rent have been covered, and that an itemized list of damages will be presented to Tenant in evidence of the deposit used to cover these items.

LEGALITIES

If during the terms of this lease, the government intends to use this premise for alternate purposes (e.g. If the state transportation department decides to build a highway through the premise), Landlord stipulates that the lease ends when the premise becomes property of the involved party (i.e. this contract is invalid with the initiation of court hearings. Until culmination of trial period, rent continues on a month per month basis).
