Part 1: Reflection

The module is important with its relevancy to the Aviation industry since it would help understand the law of aviation in the country. When one has to adopt a professional career in a certain field, one has to get familiar with the laws and policies, which are a ‘code of conduct’ for carrying out certain actions that are allowed and preventing those prohibited. It would be better to follow that code of conduct under the guidelines of the regulations so that legal actions could be avoided in the future.

My personal view about the contents covered in the module is satisfactory and positive since I believe the content would assist in knowing the Australian Constitution closely regarding its features and relevancy to aviation law. The aviation law student must be aware of the country’s court system if its law is to be reviewed, which is one of the main contents of this module. Both Australia’s state and federal state systems have been added to study aviation law and thorough knowledge of the legal system.

Part 2: What Areas of Law Did the Lecture Consider?

The areas of law that the lecture considers include the difference between common law and civil law procedures, understanding the relation of the Constitution with Aviation law, comprehending the court structure and its responsibilities with relevance to jurisdiction, and the process of appeals from lower courts the High court. Common law and equity had been the heart of the discussion wheeler the course contents were taught since it is vital to know both highlights and differences regarding aviation. Where common law provides the general rules that could be applied in aviation matters, equity law ensures that equitable rights are provided to the affected parties to keep a check and balance of the common law. Separate enactment of codes has been guaranteed with the modernization, and the increased importance of aviation as approvals of certain aviation adjudication is necessary. It still becomes notable in countries where there are national and local courts to take care of administrative functions of aviation and their interrelation with the judiciary. Also, the continuation of classification of law was discussed, such as covering Canon Kaw, Chinese law, Jewish law, Russian law, Sharia law, Socialist law, and Customary law.

Further, countries with civil legal systems and countries with common law have been listed. Their differences have been elucidated with a demonstration of even their respective courtrooms. It has been clarified that law could be additionally divided into other classifications: private law, public law, substantive law, and procedural law.

The legal principles or elements that have been discussed incorporate the law of contract used in hiring an aircraft, law of torts that could be used when the passenger is injured on a scenic fight, administrative law applicable in industrial or industrial, or employment arenas. Moreover, separation of powers, legislature, legislative powers, court structure, and court reform has been detailed. There is even a useful link added to the course content that could be viewed to gain additional information about the court structure.

Part 3: What Cases Did The Lecture Consider?

Since classifications of the court structure have been mentioned, the types of cases that each court structure handles have been indicated. No specific name of the case has been included, rather only the types of cases. For instance, the Magistrate court is responsible for taking care of Commonwealth matters encompassing Customs Act 1901, Social Security Act 1991, and Taxation Act 1953, which could be applied in aviation matters. Aviation could take help from these matters if the concerned departments of aviation know-how, for example, an action regarding a person boarding on the plane or being removed from the aircraft would be carried out by the administrator based on his legal authority.

The lecture highlighted some salient features of the court system along with its history. It has been mentioned that aviation law came into being when the Wright brothers introduced the first plane, which made the law even more important and pertinent for the country. Although, there were court reforms for considering the monetary limits and the matters the court would handle. For instance, it was simplified what matters Queensland Civil and Administrative Tribunal (QCAT) court would handle, like consumer trader disputes, debt disputes, minor civil disputes, administration for adult matters, other civil disputes, building disputes, anti-discrimination matters, occupational regulation matters and administrative decisions making matters, etc. It would be noted that these areas could be related to aviation, although QCAT includes children matters as well.
