Criminal Court System

Restorative justice is the application a theory that puts emphasis on making amendments on the harm that has been caused by unjust behavior. This approach is practical and biblical when it comes to dealing with problems of punishment and crime to the society.it is based on simple principles whereby it recognizes that any crime committed caused harm to people meaning that it is not basically about breaking the law. The aim of the restorative justice system is therefore to amend injuries that result from crimes that are committed. The system also believes that crime is not just a matter between the individual offenders and the government rather it affects other members of the society as well. Since the victims of a crime and the entire community bear the burden of a crime they all have to actively take part in the this criminal justice processes (New Zealand Ministry of Justice, 2014). This restorative justice system involves; restoration of victims, offenders and the community. For the victims the injuries that the crimes cause may lead to a disruption of their lives and they feel as though they are being victimized by the criminal justice system if they are excluded from the process. Restoration justice system therefore aims at promoting the importance of considering the concerns of victims. For offenders this system requires that they have to be held more accountable and confront the pain they caused their victims hence punishment has to be delivered to the offenders. They are also supposed to be given the opportunity to rehabilitate. Since crime leads to injury in the communities the system gives he communities an integral part in assisting offenders to get back into the society and bringing back peace (New Zealand Ministry of Justice, 2014).

The crime in the case study had effects that went beyond harm to the immediate victim in that many other people were affected by the crime apart from the victim. Betty, Mildred's daughter was one of those who the crime affected since she was the one who was taking her mother back to her house when they met with the incident. She had to stay with her mother for a few nights since they thought it was not safe for Mildred to stay there alone. The people in the community voluntary group known as Caring Neighbors were also affected by the incident I that they had to bring in meals for Mildred since she felt so insecure and thought she did not know her neighbors. These volunteers help those who are going through tough times and they were also affected by the crime since they had to step into the situation and assist Mildred after the ordeal. Helen a volunteer was also affected by the crime since she had to pay Mildred a visit every evening so as to find out how she was doing. This means that she had to change her schedule so as to make sure she pays her a visit hence it means that her life was affected in one way or another as a result of this incident. All these clearly show that it was not Mildred alone who was affected by the crime but all those who came in to help her cope with the situation were also affected.

The restorative justice system and contemporary justice system differ significantly in that in the contemporary justice system the focus is mainly on what law was broken, who broke this law and the punishment that was given to the offender on the other hand the restorative justice system focusses on who was harmed, the needs and responsibilities of the people who were affected by the crime and how the parties involved get together to address and repair the harm (RJcity, 2007).
