¶ … Title IX of the 1972 Education Amendments are that it prohibits discrimination against female students in public schools and in private schools that are recipients of federal financial aid. Another positive result of the passage of Title IX was the creation of provisions for equal treatment of females in athletics. In addition, the law is also the basis for claims of sexual harassment. This has created some benefits, but also some drawbacks. For some, Title IX is a prime example of how intrusive actions of the federal government can be (McCarthy & Cambron-McCabe, 1992).
How do the benefits of No Child Left Behind compare to the drawbacks?
The NCLB Act is designed to hold teachers and schools systems accountable for turning out higher-scoring students. On the positive side, this allegedly encourages teachers and students to work harder to do better. On the negative side, it forces teachers and students to focus primarily on rote learning in order to pass standardized tests, and this essentially takes all of the creativity out of the teaching and learning process (Yell & Drasgow, 2008). Since creativity is a much more important part of learning than being able to memorize answers and spit them back out, I believe the drawbacks definitely outweigh the benefits.
3. What can teachers do to protect themselves from the possibility of lawsuits?
Educators need to understand the laws that relate to education in general and to students, employees, parents and guardians in particular so they can confidently face the legal implications and responsibilities of their role. Educators are not expected to be versed all legal matters, but they must know enough to understand when to seek legal services, what to do and what to avoid to remain in compliance with a law, and how to protect the rights of individuals. Awareness of legal considerations and implications can help educators follow what the law requires and avoid legal entanglements (Imber & Van Geel, 2004).
