Elements of a Business Contract

The successful business contract has several key elements that will help make it successful. The first article located on the Quicken.com Web site gives much useful information in a concise, well-written article. The author first lists several reasons a business contract might be necessary, including consulting services, leasing of equipment or real estate, manufacturing, and even when payment is due, along with several others. He then lists the items that should be contained in a standard business contract, including the names of both parties, the date of the contract, the length of the contract, the price, or cost of services, and what those services will be, among other considerations. Perhaps the most helpful elements of this article are the items that deal with contention or disillusion of the contract.

Some of this information might seem too simple or elementary to be included in these elements, but the author is quite thorough, and includes all the information necessary, in case one of the parties forgets or overlooks an element. All of the elements the author includes are important parts of any business contract, and if even one is left out, the contract could be contested later. The author also adds information on how to terminate the contract, which some less experienced businesspeople might forget to add to a contract. In fact, many of the final elements discuss conflict dispute and other problems with the contract.

These elements are all quite thorough, and it is clear the author has much experience writing and advising others about business contracts. Before anyone enters into a business contract, it would be wise to consult articles such as this one so they understand all the nuances of a contract, and do not leave any element to chance. This is one of the articles that should be consulted, because it is thorough, easy to understand, and leaves no element of the business contract undefined or unexplained.

The second article from Allbusiness.com makes many of the same points the first article does. It is interesting to note that the second article begins the discussion with payment issues, rather than the more systematic approach used by the first article.

This article gives much more detail about certain aspects of the contract, especially in the liability and breach of contract areas. This is good background for anyone to understand what can happen when an agreement sours, and helps create a broader foundation for writing a contract. It also gives a much clearer account of the many things that can go wrong with a business contract, and what to watch out for before signing any contract. This article also points out the need to read more than one or two articles on any subject, for a more thorough understanding of all the items involved and elements necessary for completion. Reading only one of these articles would not give the reader a complete idea of a business contract, but reading both articles gives a much more useful picture of what to include and watch out for.
