Creating a Federal Law Banning Gay Marriage is not Democratic

The freedom of expression, pursuit of happiness are guaranteed under the American Constitution; so long as those rights do not cause harm to, or infringe upon the rights of another or group of individuals. Just as heterosexual unions are the expression of feelings and commitment between heterosexual couples, and reflect their pursuit of happiness; so, too, should that same freedom of expression and commitment and pursuit of happiness be allowed to gay and lesbian life partners. A federal law banning such unions, thereby eliminating the exercise of testing the support or lack thereof, for same-sex marriages at the state levels would be undemocratic.

The courts have been consistent in their support of freedom of expression in writing, art, and oration; now, they should be equally diligent in supporting that freedom as an expression of commitment between two individuals without consideration of the gender of the individuals making the commitment. While the First Amendment is specific in its description of freedom of speech, the courts have upheld that idea in cases that involve freedom of expression (Stewart, James Brewer, 1987, p. 43).

The American Constitution likewise guarantees men the freedom to pursue happiness; it does not guarantee that dinner will be on the table after a long day's work, or that your marriage will not end up in divorce court; or that your son won't drop out of law school to pursue a career as a rock musician. It is the pursuit of happiness that the Constitution guarantees with respect to a person's right to pursue a free life. The words are written this way (Von Eckardt, Ursula M., 1959, p. 2):

We hold these truths to be self-evident, that all men are created equal, that they are empowered by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the pursuit of happiness."
