¶ … private vs. public defense In the event that one gets arrested or sued for a given crime, there are often issues that the defendant would like to consider before settling for a private or a public attorney. It is hence wise to decipher the likely differences of each attorney and know what advantages come with each. The paper will hence highlight the positives and the negatives that have been noted on each category of lawyers.

The public defenders are known to have several cases that they are handling at one given time, well into hundreds at times. This may cut b both ways, it could mean they will expedite your case so as to reduce the pile of cases, hence your case ending sooner than that of a private defender who has fewer cases hence not in a hurry to have them dealt with.

But on the reverse, it could mean that your case may take much longer than anticipated if the defender has problems in scheduling, or if due to more urgent cases like murder, your case, among others have to be pushed back. The private defenders in this case rarely have scheduling problems and often handle the case as scheduled with the client.

Some clients would not fancy a lot of face-to-face meetings and for such the public defenders would be the best as compared to the private defenders who would like to schedule a lot of face time to discuss the case with the client. The public defenders are weighed down by many cases such that the client meetings are merely a few minutes before the representation in court. On the other hand, the private defenders who have lesser cases spend hours discussing the case with the client.

This works both to negative and positive of the client, in that, the client may have ample time to give all the crucial information needed to weigh in on the case as well as receive proper briefings by the defender, yet on the negative it may seem bothersome for any client who has tight schedule and lesser time to spend sitting down with the defender, which may result in his case being pushed back due to lack of time to be briefed.

In the event that there are civil proceedings as well as administrative hearings, then the public defenders cannot handle such and hence the client must look for a private attorney which could be an additional cost for the individual since he has to switch from the public attorney to the private attorney (Public defenders, 2015).

There is also the pro of using the public defender in that even the low income families or clients are able to get good representation in court which is less intimidating than them having to represent themselves in court. Individuals who are on their first crime are more likely to be intimidated by the judges and prosecutors hence the public defenders come in handy to save them from such especially if they are not in a position to afford the private defenders who are often expensive.

In most states the services of the public defenders are obtained free. The public defenders often tend to want to dispose of cases much faster than the private defenders, hence for an individual who wants his case quickly dealt with and summarized, he is better off with the public defenders as opposed to the private defenders who will, in most cases, take his time with a given case since he will be generating income for every appearance in court.

The challenge is that the quick disposal of the case may not necessarily mean the desired resolution that the client was looking forward to, hence some clients would rather take their time on the case, collect funds from all relatives and even loans to handle the case but stick with the private defender who will take his time and return the desired outcomes (Law Offices of Bradford Kvinta, 2014).

Another debatable pro that the private defenders have over the public defenders is the fact that the private defenders will put in maximum diligence in dealing with any given case. As opposed to the public defenders, the private defenders are known to work in closer relationship.
