I was notified there would be a political demonstration in a public city park, showing support for changes in immigration policies in fifteen weeks.
I was also advice that the opposition would be there to create a counter demonstration at the rally. I am extremely concerned for the safety of the public and police offers, since there is a high risk of violence at this rally. As the mayor I feel it is my obligation to take action to prevent this demonstration from occurring. An emergency change in legislation must be created to prohibit this demonstration from occurring as scheduled. Creating a legislature to prevent this demonstration from occurring would be extremely difficult.
Stopping this rally would be an infringement on the first amendment. The first amendment protects the rights of individuals to engage in freedom of speech. It is not within the power of the authorities to limit freedom of speech or freedom of congregation in a public park. As the mayor I would have to prove to the legislators that this demonstration would be harmful to the general public and safety of the police officers.
Although freedom of speech is guaranteed, it does not mean the state, city or any other form of government must spend an enormous amount of money to protect the protestors. The city of Lakewood, New Jersey refused to protect protestors at a demonstration scheduled in 2007 because of the cost associated with police protection (Digger, 2007). The demonstration was scheduled to be held by local citizens, protesting immigration policies. Authorities in Lakewood refused to pay for police protection for this demonstration, causing the demonstration to be cancelled.
The mayor's office must prove that it would be an enormous cost to utilize the amount of police officers necessary to maintain the safety of the protestors and the public at this demonstration. The extreme cost of the police staff would be a financial burden on the state and the city. I would create an argument to pass a new legislation prohibiting demonstrations that would cost the city too much money to ensure the safety of the public.
In order to ensure the legislation is approved, I need to provide research that would support the theory of high violence at such as demonstration. Research must be conducted about similar gathering in different cities to support this theory, that this demonstration would require a large amount of police protection. According to the office of censorship it is important for legislators to take action to censor meeting and demonstrations that would cause violence and create destruction (Office of Censorship, 2007).
As political leaders when changing the constitution we should always analyze the impact of the change. We must evaluate the effect changes in legislation would have on the community at large (Mackey, 2001). This emergency legislation would restrict the demonstration, location, time and place because of the cost associated with.
