Understanding is defined as the defendant's capability to comprehend pertinent pieces of a trial. Appreciation evaluates his or her aptitude to understand the legal situation, particularly examining whether delusional convictions or other psychotic indicators affect their capability to comprehend the character and severity of what is happening. Reasoning means the defendants' capacity to choose which facts are germane to the defense of a theoretical situation (Akinkunmi, 2002).

The American Bar Association, around 1994, saw that the subject of mental incompetence, was the most critical issue in the criminal mental health field.

However, not very much was really understood about a defendant's mental capability to make proper choices. Since over 85% of criminal trials in this country are determined by guilty pleas, rather than holding a full-blown trial, a solid factual base for the hard judgment of competence was not in existence.

The hurdles to any movement was the missing factual base needed, and controlled research procedures in order to evaluate abilities related to the mental capability to make proper choices and to stand trial. The MacArthur Competence Study was developed to put in place those procedures and utilize them to give data to medical and legal experts to assist them in answering inquiries about the mental competence of defendants to make informed choices (Melton, Petrila, Poythress, Slobogin, & Lyons, 2007).

Starting in 1988, the study accomplished three things. First, it communicated a sound legal hypothesis of what "competent" meant in the framework of the social reasons that legal tenets for judging competence are meant to enhance. Second, it built on the mental-legal evaluation approach began by the MacArthur Treatment Competence Study to design and test an investigative tool to gauge the capabilities acknowledged by the hypothesis as essential to the capability to make informed decisions. Finally, the study carried out the first investigations of the incidence of impairments in decision-making capability among the general populace of criminal defendants.

After the research a full-scale study was conducted with over 350 adult male defendants and 100 adult female defendants signed up from two states (Various, 2005).

The 22-item clinical instrument that resulted -- the MacArthur Competence Assessment Tool - Criminal Adjudication (MacCAT-CA) -- was field-tested on a sample of 107 criminal defendants in a jail and in a forensic hospital in Virginia and found to possess psychometric integrity. The MacCAT-CA is now available for clinical use (Various, 2005).
