Fiduciary responsibilities
Fiduciary responsibility refers to a relationship whereby an individual has the responsibility of taking care of the rights and assets of another person. Therefore people who are working in the healthcare field are entrusted with a significant fiduciary responsibility. This is because they are entrusted with both the assets within the field, hence expected to take care of them, at the same time render services to people. It is important to recognize this fiduciary responsibility given to them since the healthcare field is very delicate and one that requires a lot of care and caution. The fiduciary responsibility of those working in the health care field include; avoiding any conflict of interest when they are at work, acting in the interest of the healthcare organization as opposed to their personal interest, providing an oversight to ensure that any transaction within the organization is conducted in a legal way and finally making decisions which protect the assets of the organization and does not lead to their destruction of waste. Therefore those working within the healthcare field should always make sure that they uphold their fiduciary responsibility whenever they are carrying out their duties in the healthcare organizations since the aforementioned reasons are a clear indication that they have been entrusted with significant fiduciary responsibility (Shortell & Kaluzy, 2009).
Legal remedies
Legal remedies are ways through which a right is enforced b y a court of law incase of injury, harm or a wrongful act is imposed on a person. Incase there is a breach of duty through violation of some rules set then the court will make some ruling according to the offense that has been made. There are various legal remedies that can be applied in court such as proprietary remedies this are remedies that involve property and personal remedies which deal with monetary compensation. Once a court has established an existing relationship between a plaintfill and defendant then they can be in a position to impose the necessary remedy depending on the nature of the contract that exists between the two. An example is whereby an individual working within the healthcare field uses the resources or assets of the organization for their own benefit or wrongfully they can be charged with a breech of contract and the court imposes a proprietary remedy upon them. Another example is when those who are working within the health care field misuse money for such organizations that is meant to be used for development they are charged with personal remedies in court.
