Torts law and legal principles

Tort law relates to the majority of all lawsuits in Civil Courtrooms. In fact, nearly every claim that is set in civil court except for contractual disputes is under the heading of tort law. Tort law is used to address a wrong a person has done to another person and generally involves the award of monetary damages to compensate for the wrong done to them. There are three types of tort law including:

(1) Negligence;

(2) Intentional; and (3) Strict liability torts. (Investopedia, 2013, p.1)

Description of Different Types of Torts

Negligent torts relate to harms done by one person to another in terms of their failing to exercise what is known as a reasonable standard of care and specifically such as accidents that occur due to carelessness. Intentional torts are such that involve willful misconduct on the part of an individual and strict liability torts are such that are not concerned with the individual's culpability but has as its focus the act with no regard for the standard of care or the intentions of the individual.

II. Experience in the Business World

One example of an intentional tort is an incident, which occurred and involved an individual assaulting the writer of this work. The individual who committed assault was drunk and hit the writer of this work over the head with a beer bottle causing the writer's head to have a gash cut into it. The writer of this work had to go to the hospital and get stitches in their head and subsequently, the writer of this work missed two days work due to having a concussion from the blow to the head by the beer bottle the drunken individual assaulted the writer with when assaulting the writer. This is an intentional tort and as such the individual committing the assault could not only be arrested but they could be sued in a civil courtroom for damages and even punitive damages.

III. Damages

Damages that the person committing the assault would face would include the medical charges for medical treatment provided to the writer of this work as well as the amount of wages that the writer of this work would have earned if they had been able to work the two missed days due to the injury. It is likely, that in such a case that the award of damages would include punitive damages or damages that are a type of punishment to the individual who committed the assault.
