The sale of a computer would be governed under the rules set forth by the Uniform Commercial Code. The UCC sets down a set of specific rules and regulations as it applies to the sale of goods or merchandise (UCC: uniform commercial code, 2004). The computer that I would be interested in purchasing is that of the Toshiba Satellite L500-ST55X3. This computer has a list price of $829. The company is currently offering free shipping on this product (Toshiba Laptops, 2010).
The computer comes with a free limited warranty although there are several warranties that can be purchased. The limited warranty basically states that Toshiba and its parent companies disclaim all other warranties, express or implied, with respect to all Toshiba brand products. This includes but is not limited to the implied warranties of merchantability and fitness. Toshiba's liability for warranty claims on branded products is limited to repair or replacement as set forth in the applicable warranty statement. Toshiba does not provide any warranty for third party accessories or products. Third party suppliers are solely responsible for all warranties, services and support (Toshiba Laptops, 2010).
Toshiba's return policy states that all returns must have a Return Material Authorization (RMA) number. This number must be obtained within fifteen days after the customer receives the product and all products must be returned to within ten days of receiving said number. Toshiba will only refund the original purchase price of the product along with any taxes that were paid. The original shipping and handling charges or any other fees along with return shipping charges will not be refunded. Returns that are received without an RMA number will be rejected. Customer is responsible for all shipping charges and the risk of loss in regards to all returned shipments. The customer is required to a trustworthy shipping carrier that is capable of making available proof of delivery. Customer must properly pack and fully insuring the return shipment. Once Toshiba gets the product back they will examine it in order to be certain that all parts are included and that there was no abuse or misuse of the product, or any negligence on the part of the customer. All products have to be returned in the original packaging and be in the same condition that they were in when the customer got them. The return may be rejected, or costs deducted for missing parts, non-original packaging, abuse, misuse or user negligence (Toshiba Laptops, 2010).
