Although collecting third party information about a person is no longer stringently protected after the Patriot Act was made into law, monitoring and recording the online activity of private citizens requires a warrant according to Katz v. United States and Kyllo v. United States. The relaxation of privacy protections by the Patriot Act therefore violates the spirit of the Fourth Amendment and should be declared unconstitutional.
