This paper examines the suspension of habeas corpus in the context of the so-called war on terror. It examines the history of habeas corpus as a legal concept from the Magna Carta onward, and more specifically examines its prior history in America: its mention in the suspension clause of the US Constitution, its actual suspension by President Lincoln during the US Civil War, and its role in war-on-terror jurisprudence in the Supreme Court's Boumediene decision.
