Ladies and gentlemen of the jury, the first thing I would like to discuss with you in my closing argument in defense of Scott is this: If Scott had, as the prosecution alleged, killed his wife and child then certainly any individual who had committed such a crime would not have given an alibi that would have caused themselves to appear to be guilty due to the location of their alibi.

This in itself, other than the fact that I know Scott is telling me the truth, but that would just in itself tell me that Scott is not guilty. The question we should ask ourselves in light of this information is this: "Did Mrs. Peterson attempt to come to where her husband was that day and in the course of going to meet him run in to some kind of trouble?" Is it possible that someone was pursuing Mrs.

Peterson and she was waylaid and then murdered before ever reaching her husband?" Indeed that appears to be possible as well as plausible. Secondly, we have very good reason to believe that the baby was born prior to her death which gives a very good basis for "reasonable" doubt since Scott, as closely as he was trailed by the police after Mrs. Peterson's disappearance, could certainly not have found his wife and attempted her any harm. Brian Peterson, stated that the baby was full term, at the time of Mrs. Peterson's disappearance the baby was most emphatically not a full term baby, thereby ladies and gentlemen giving you not only "reasonable" doubt. In fact, you have what is convincing reasonable assurance that; Scott Peterson did not murder his wife.
