I would not ask for jail time because I don't feel it would serve any beneficial purpose in this case since the Defendant is not a danger to society. If the defense counsel indicated that they were interested in entering into a plea bargain, I would most definitely be open to the suggestion. The minimal plea I would be willing to accept would be a suspended sentence with probation. Under such an agreement the Defendant would be found guilty of the charge and sentenced to pay a certain amount in fines. However, the Defendant will not have to pay this fine so long she stays out of criminal trouble. I feel this offer is a positive resolution to this matter because it essentially empowers the Defendant and makes them responsible for their punishment.

As indicated by my potential approaches to this matter, from both a defense and prosecutor's side, it is clear that I would favor a punishment driven by the theories...

My thinking is swayed by this Defendant's young age, lack of criminal history, and unfortunate place in life. The best thing that could happen to this Defendant is to get back into school and/or become employed. Using the criminal justice system, the Court can order the Defendant to do exactly these things. The hope would be that as a result of these programs the Defendant will be able to turn her life around and start down a crime-free life. This, of course, would benefit society more than simply making her pay a fine and putting her in jail. All jail would do is give her a place to live for a few days and send her on her way, just as she was prior to jail. As she grew older and without an education her opportunities will continue to become limited. When an individual has limited opportunities, many turn to drugs and alcohol and other deviant behavior-something that is not in society's best interest.
