When a paralegal is hired, it is the employer's responsibility to determine whether there is any potential for conflict related to prior client representation. The paralegal is held to the same level of obligation as any lawyer is to inform the new employer of any conflicts. The new employer is responsible for screening any possible commonalities and making an effort to minimize the affects of prior knowledge.

Where a possible conflict of interest arises, attorneys may want to: 1) create an ethical wall by prohibiting the paralegal from having any connection with the matter; 2) ban discussions with or the transfer of documents to or from the paralegal; 3) restrict access to the files;
