This article details the manner in which evolving IT technology and IT systems are changing previously well-settled areas of American constitutional law. For example, now that cellular telephones typically provide multiple functions and store much more information than records of phone calls, different state and federal district courts have arrived at very different conclusions about the admissibility of informational evidence retrieved by law enforcement authorities from cellular phones properly seized incident to arrest. In some cases, evidence has been excluded because the courts determined that data mining of these devices requires a search warrant; other courts have not extended that level of protection to data stored on cellular phones. This source is relevant to the project because of the implications of IT development and civil rights, most notably, the Fourth Amendment protections against unwarranted search and seizure.
