A business's ability to remain in business is influenced by many factors, and a project-based approach to evaluating feasibility would likely make more sense than framing the issue in terms of the business as a whole. Tying compliance requirements to overall business viability is arguably too onerous. The clause should not have been omitted, but it should have been reframed in a more realistic and targeted manner.
