A test case for similar litigation in Gwinnett County, Georgia awarded a couple $317,002 to compensate for injuries sustained when the Rhino ATV tipped over and crushed the husband's leg in a 2007 accident (Peters, 2010). The plaintiff had been driving the vehicle, stopped, and turned the steering wheel to the right when the vehicle tipped toward the driver's side, trapping his leg underneath and causing the bone to be exposed. The area where he was driving was described as an uneven but relatively flat, grassy surface. The plaintiff argued that the vehicle did not have a barrier to contain the rider's legs inside the vehicle. In other cases against Yamaha, plaintiffs had argued that problems with the Rhino's stability caused the vehicle to roll over easily.

Yamaha argued the accident was caused by the driver's speed and steering, claiming the driver was reckless and had aggressively misused the Rhino in contravention of clear warnings. The award covered pain and suffering damages, medical expenses, lost wages, future lost wages, and loss of consortium. No punitive damages were awarded in this case. The jury was persuaded significantly by the fact that Yamaha had not performed any testing specific to "occupant containment and safety."

Strict Liability and Negligence Analysis

The plaintiff's argument that the vehicle lacked a barrier to keep the rider's legs inside constitutes a strict liability claim under tort law. That same testing established that the Rhino ATV was dangerous under conditions involving both the seatbelt restraint failure and the absence of netting to contain occupants' extremities.

The strict liability claim regarding the Rhino ATV's tendency to tip over easily was not proven through professional testing in this particular case and would have required separate proof in other cases. Nevertheless, the rollover stability issue represents an additional strict liability theory that could render the Rhino ATV a dangerous, defective product — particularly given the number of consumer injuries reported. With over 100 cases filed against Yamaha, the aggregate compensation exposure across all claims would have been substantial.

The compensation awarded in this case was adequate for the injuries and suffering endured by the plaintiffs. When someone is injured, they lose wages until they have recovered to their pre-injury capacity, and consumers suffer greatly during these accidents. Where the injury results from a purchased product, the manufacturer bears responsibility because they produced and sold that product.
