Acceptance Letter to Physician Assistance School
I can still remember his face that day: ashen, writhing in pain, tremulous. It was a good face -- one that had reflected love and caring to almost everyone who had known him, one that had contended daily with a debilitating condition that he fought to hide in his zest for life. It was the face of my father, the man who had raised me. And now, after dealing with cardiac disease for most of his adult life, my father was gone, one of the many claimed by this treatable condition which left me, like so many other caring family members, with nothing but memories…and an ardent determination that will not be denied.
Ever since the recent passing of my father, I have been almost singled-mindedly devoted to becoming a physician's assistant so that I can do all I can to ensure that others do not…

IMAGINING A PESENT DAY NOBLE PEACE PIZE SPEECH BY D. MATIN LUTHE KING
The objective of this study is to imagine that if Dr. Martin Luther King were to win the noble peace prize today what he would say in his acceptance speech. This study will consider his ideals and principles when creating the speech as well as consider his noble peace prize acceptance speech decades ago.
The Speech
Your Majesty, Your oyal Highness, Mr. President, Excellencies, Ladies and Gentlemen:
I accept the Noble Prize for Peace at a time when the first Black man is in the office of presidency of the United States and when the United States of America faces threats such as ISIS focused on destruction of our citizens, our Homeland, and our Democracy. The dangers we face in today's society is one that is not racially-based but instead one that targets our civil liberties and constitutional…

Business Legal Case
The author of this response is offered a business legal case and is asked to give an opinion on whether one firm has a case against another. The author of this report will offer a response and will back it up using arguments going either way. In short, the answer up front is that ABC Corporation probably does not have a case but Mr. Jones acted quite carelessly and can get himself into quite a legal pickle in the future if he is not careful because he is leaving his fate to judicial review when he makes decisions like the one he made here (USLegal, 2013).
Points against Mr. Jones
Jones has two things working against him in this case. First, he was foolish enough to not have an expiration time and date for the counter-offer he made. ABC had one and there is a reason. If no expiration…

acceptance, there must be consideration, the terms of the contract must be legal and there must be an intent to create legal relations (iley, 2012). There must also be mutual consent and understanding of the meaning of the terms. For a contract to be enforceable, there must be performance or delivery, and good faith (Larson, 2010).
In this situation with Mary Smith, there is consideration (the food), and the consideration is legal. While there are two counterparties, there is not necessarily mutual consent here. Gourmet Heaven intended to create legal relations with Mattie Smith, not Mary Smith. Mary Smith did not know where the package was from and in any case did not seem to intend to create legal relations with anybody. So while Gourmet Heaven acted in good faith and made delivery, that was with Mattie Smith, not Mary. There is no enforceable contract between Gourmet Heaven and Mary…

Interface Design & Software Acceptance
Interface Design & Software Applications
Previous research efforts have focused on particular pre-existing software with little focus on behavioral antecedents. Theoretical perspectives highlight the need for marketers to understand the importance of the adoption and acceptance process of next generation software in the current market. Conclusions from research have indicated a gap for behavioral antecedents that have led to a void in marketer's ability to understand and predict consumer behavior.
Lack of user acceptance impedes the success of new software. User acceptance is a pivotal factor in whether software will be used. Usability involves effectiveness, efficiency, engagement, error tolerance, and ease of learning (Quesenbery, n.d.). Accessibility involves usefulness to measure whether the actual users can achieve the goals (Anon., 2000). Interface design affects whether users use particular software. The study is to determine how users make decisions to use software based on the interface design. How the user…

Contract Law- Offer and Acceptance
Judgment for Zinni. According to §2-206 of the UCC, unless otherwise stated, an offer to make a contract is to be construed as inviting acceptance in any manner. Although Royal's form contained a clause that the order was not binding until accepted by the dealer or his authorized representative, the clause did not limit the method of acceptance. Both Zinni and Royal filled out a written order form, which demonstrated a meeting of the minds. Furthermore, the fact that it was Royal's order form was enough to make it an enforceable writing against Royal under the Statute of Frauds as embodied in the UCC.
Reserve was incorrect in its defense to Duckett's claim. According to the mailbox rule, an acceptance (except in cases of option contracts) is valid at the time that it is placed in the mailbox. Therefore, Duckett's acceptance was considered valid on the date…
Technology Acceptance Model
Using Technology Acceptance Model (TAM) to Assess User Intentions and Satisfaction on Software as a Service (SaaS):
The Value of SaaS
Software as a Service (SaaS) was researched by Benlian and Hess (2011) in an effort to determine its value to companies. Among the arguments was that SaaS is already declining in popularity even though it is very new. The majority of the arguments that lean in that direction have been made by individuals who believe that SaaS is not offering the level of value that was originally expected of it (Benlian & Hess, 2011).
The main reason they feel that SaaS is lacking in value is because there were many problems with the deployment of it in the beginning (Benlian & Hess, 2011). At that point, there was a concern that the application would not work well because it was not ready when it was first made available. Many people…

Contracts Scenario
On June 15, Peters orally offered to sell a used lawn mower to Mason for $125. Peters specified that Mason had until June 20 to accept the offer. On June 16, Peters received an offer to purchase the lawn mowe for $150 from Bronson, Mason's neighbor. Peters accepted Bronson's offer. On June 17, Mason saw Bronson using the lawn mower and was told the mower had been sold to Bronson. Mason immediately wrote to Peters to accept the June 15 offer. Has Peter's offer been revoked? Is Mason's acceptance ineffective?
According to the definition of a legally valid contract, when a person is asks someone to do something, such as to purchase a lawn mower, the first step has been made in securing a contract. This was performed when Peters offered to sell the mower for a particular price. However, the second step is the other party's acceptance of the…

Generally speaking, the importance of the artist in human society has much to do with helping us to see beyond what we consider as reality and to understand how every human being is connected not only through human emotions but also through culture in the shape of iconography, being an image that relates a story, and the historical context of any given work. In some respects, art does provide much entertainment by allowing the viewer/reader to forget his/her problems for a short length of time, such as by attending a stage play or by going to see a movie on the big screen.
ut art can also be far more than mere entertainment, due to forcing the viewer/reader to ponder the mysteries of human existence and to use their in-born ability to think imaginatively and with abstraction. For example, by viewing a painting in a museum, a person can be…

UAT: The best way to go about a potentially painful process
Even for a computer programmer who is fluent in the language of the software development cycle, the time-consuming and tedious process of user acceptance testing (UAT) can be frustrating. But when the users involved in the testing are all accustomed to using a computer system that already works, and has been de-bugged of all potential glitches the UAT process becomes even more of a challenge, as developing test plans, conducting tests, and reporting results is not in the users' usual comfort zone of work related tasks. Users must critique what they usually take as givens, when using software.
But the UAT definition of using and accepting new technology and software as the end product of the development cycle and its end location in the overall process can still be a productive one. Key to making the process as painless as possible…

Missouri Compromise
The acceptance of the new Western territories as part of the United States raised the issue of slavery as a sticky issue in the politics of the nation. The concept of catering for the interest of the slaves and the pressure groups that wanted the practice banned as well as the interests of those states that wanted their rights to choose to do whatever they wanted with their slaves was a tricky concept. It became more pronounced when Missouri presented a petition to join the U.S. But as a slave state. By 1819 there were 11 free and 11 slave states hence striking a balance yet Missouri wanted to come in as a slave state which would tilt the balance if accepted. Congressman Tallmadge James gave a proposal that Missouri be allowed to the U.S. But as a Free State and not slave state. The pro-slavery states did not…

Jane and Diversity
When Demo Moore stared as Lt. Jordan O'Neil in the film GI Jane, as well as presenting a striking film of a woman fighting against the odds, there was also a social message regarding the difficulties and barriers associated with introducing and embracing diversity within established institutions and how the individuals who may seek equality and equity may face additional challenges.
The film starts with the premise that the nave is biased, as Texas Senator Lillian De Haven accuses the navy of lacking gender neutrality. A deal is made, that a number of test cases will be used in order to determine whether or not women should be integrated into all of the Navy departments, and the commitment if women are able to perform critical standards integration will go ahead. O'Neil is the first of these, and the way in which this test takes place demonstrates problems of institutional…

Personal Statement
I have taken advantage of the education opportunities presented me thus far to prepare for college in many ways. First and foremost I have ensured that I have enjoyed a wide variety of classes and electives to provide me the opportunity to explore as broad a subject selection as possible. Most of the courses I have focused on in my senior year have been college preparatory. College preparation however is much more than academics alone. I have also experienced many educational opportunities that exist outside the realm of traditional 'academics'. These experiences have prepared me more so for my college experiences than my preparatory courses. I have for example faced many challenges while growing up. During my four years of high school I engaged in a variety of extracurricular activities and clubs that taught me much more about the ways that people interact and communicate than…
Anna in the ropics" by Nilo Cruz is about literature and the role it plays for humanity, about the war between sexes, about similarities and more importantly, about differences in humans, about divide and reconciliation, about love and the way every different human being understands love in a different way. wo worlds are trying to reconcile, to find a common ground, to merge and go on in this play. On one hand, there is the huge gap between old traditional Cuba and modern USA, on the other there is the gap between what technology has done to the modern world and the old way of living. "Anna in the ropics" tackles all these and a great deal more. Men and women, tradition and modernity, north and south, are forced to deal with one another in a way humanity seems to have never seen before. he twentieth century, with all…
The gender differences combined with the conflict between tradition and modernity along with the challenges in business lead to plenty of misunderstandings. Men and Women find themselves trapped into a maze they don't know how to solve and endlessly walk around, doomed to miss the way out. If in the first Act it was Conchita who was asking Palomo for his aid in showing her how to love him again, in Act 2 is now Palomo's turn to ask Conchita for the favor of being the interpreter. Besides the intepretations of various parts of the novel that is being read, they are in dire need to have interpretations of the real life.

Acceptance and Commitment Therapy (ACT) is a form of psychotherapy that is similar to cognitive-behavioral therapy (CBT). The theory that ACT is based on is the Relational Frame Theory, which launched out of cognitive therapy, supplying missing "steps" in Skinner's behaviorism by exploring more deeply the connections between language and thought. Essentially, ACT explores the idea that what and how a person thinks is highly impactful in that individual's daily life and functioning -- and especially in how that person copes with stress, etc. But whereas CBT focuses on altering the content of one's thoughts in order to move the individual towards the target behavior, ACT focuses on changing the function of thoughts so that they do not oppress the individual. ACT, in other words, focuses on the way in which a person interacts with the interior life.
Two articles that discuss ACT are "Acceptance and Commitment Therapy: Introduction" by Michael…
Cultural Representations of GLBTQ Peoples and Communities in the Mainstream Media
Attitudes and laws in American society concerning the gay, lesbian, bisexual, transsexual and queer (GLBTQ) communities have changed in substantive ways in recent years, and many observers credit the cultural representations of these communities in the mainstream media as contributing to this progress. Notwithstanding the progress to date, though, some observers suggest that the status of the GLBTQ communities today is still comparable to the status of women and blacks a half century ago and there is clearly a need for greater understanding of these alternative lifestyles communities by the general American public. To this end, this paper provides a review of the literature concerning current GLBTQ issues in American culture followed by a discussion concerning the manner in which interpretation of mainstream media content such as films, television shows, books, plays or events can provide fresh insights into the…

Students, Prejudice and isk
Students learn to be prejudiced through experience with other persons; prejudice by others can lead to prejudice in students, especially if they feel that representatives of a group, such as teachers or persons of authority speak for the whole and express basically biased views. In this way students can become prejudiced against certain groups; or news reports in the media, for example, of the way that police officers are portrayed, can lead to prejudice in students. Peers and family members can also pass on prejudice to students, so it is something that can be handed down by background and culture, too (Koonce, 2016).
Approaches that might help develop appropriate tolerance and acceptance in students could be for schools to adopt a Zero Tolerance policy, in which no form of prejudice or bias is accepted and if it is displayed by students they are immediately disciplined without any second…

Unequal Pairs in Genesis
The source of hostility experienced by humankind has a long record and an intricate web of linked causes and ascription of causes. The highly charged concerns that human beings experience in the contemporary world are as a result of something more central and at the heart of people. Abel and Cain were brothers, but brothers who felt humiliated and threatened by actions and attitudes of each other. They were brothers who sought for exceptional favor and blessings from the same Creator they worshipped in distinctive ways. However, God accepted the sacrifice presented by Abel and rejected that of Cain. The rejection of Cain's sacrifice and acceptance of Abel's sacrifice demonstrate the need for people to choose between salvation and eternal torment, righteousness and wickedness.
The story of Cain and Abel follows upon the tale of sin of humanity, and represents humanity's further estrangement from God. The anecdote of…

Faustus' Acceptance to Eternal Damnation
Many traditions and legends have been created all the way through the long history of western culture. Among which one of the most outstanding and well-known as well long lasting traditions of western culture is of the Faustus legend, where in this legend, a man called Faust or Faustus, sells his soul to the devil for almost twenty-four years for the purpose of worldly power. This makes it a very prominent story that has been narrated many times over by writers such as Goethe, Lessing, and Mann. However, most probably the famous telling is Doctor Faustus by Christopher Marlowe.
The social upheaval during the time period is the most prominent influence on Marlowe's version of Doctor Faustus. This novel has been suspected of being first performed in 1594, which was a time of great change in Europe. During this period the Medieval Times were over and…

My passion for architecture and design dates back to my childhood. I have amassed through the years quite a collection of antique design books and magazines, picking them whenever I could at flea markets and second-hand book stores. It is fascinating to observe how good design never loses its charm and function, no matter the age of the building or decor. Moreover, the elements of good design are repeated from one era to another regardless of the overall character.
I have always been a hard worker and taken pride in my accomplishments. Moreover, I enjoy the process of achievement and success, such as transforming ideas and thoughts onto paper in the anticipation of someday seeing my creations come to life. The…
Many researchers have conducted studies on many aspects of m-commerce and the use of mobile technology by consumers. deuyter, Kleijnen, & Wetzels (2006) stated, "M-commerce has been heralded repeatedly as the new service frontier of the millennium. Present market reality, however, seems to be less optimistic, therefore, the current study explores the factors contributing to the adoption of mobile services in a context of wireless finance" (p. 206).
Organization of the Study
Chapter two will consist of the literature review of published works and research studies on the subject of mobile commerce. There are many points-of-view and definitions of m-commerce and this chapter will attempt to examine the data as it relates to what is also referred to wireless e-commerce.
Chapter three through chapter five will substantiate and provide the details of the research methodology utilized for collecting the data. The collected data will be used to answer the research questions.

Ethical Practice Involves Working Positively Diversity Difference
Counseling is a profession that involves associations based on principles and values ethically. Patients are able to benefit by understanding themselves better and through creating relationships with others. Through counseling, the clients are able to make positive alteration in life and enhance their living standards. Communities, organizations, couples and families are different groups of individuals are main sources of relationships (BACP Ethical Framework, 2013, p.4). Frameworks of ethical practice direct the attention of counseling practitioners to engage in ethical responsibilities. This stud describes the purpose of each principle following the development of good counseling practice. Practitioners make reasonable decisions grounded on these principles without making any contradictions. Nevertheless, research indicates that professionals have met barriers hindering them to integrate all the principles in some cases. In such situations, they are forced to select between required principles. A course of action or a decision is…

On the eve of expiry of the offer, B obtained a report from the county recorder of deeds that he (the recorder) had obtained a deed of Greenacre from A to C. executed on that day. Following assumptions that the recorder was probably wrong, B notified A of acceptance of the written offer on the fifth day. While the information provided by the recorder was found to be erroneous, A denied the existence of a contract between him and B. This scenario has generated several concerns on whether A was right, especially if the report was reliable. Additionally, there are questions on whether the report may have been reliable despite being erroneous.
The above scenario is an example of a contract law issue and specifically deals with the issue of the…

Good researchers tend to pull methods out of a tool kit as they are needed" (2006, p. 54). Notwithstanding these criticisms and constraints, though, most social researchers seem to agree that classification by some type of research paradigm is a useful approach based on the need to determine which approach is best suited for a given research enterprise. In this regard, Corby concludes that, "The contested nature of research makes it impossible and unhelpful to ignore the different aims and purposes of various research projects and the methods and approaches being used to carry them out" (2006, p. 54). Therefore, the different aims and purposes of the positivist research paradigm, the constructivist research paradigm and the pragmatic research paradigm are discussed further below.
Positivist Research Paradigm
The positivist research paradigm is a quantitative-based approach that generally seeks to identify trends and patterns that can be used to formulate predictions concerning how…

Ames, S.L., Gallaher, P.E., Sun, P. & Pearce, S. (2005). A Web-based program for coding open-ended response protocols. Behavior Research Methods, 37(3), 470-471.
Authors provide a description of a Web-based application that provides researchers with the ability to analyze participant-generated and open-ended data. Authors note that the application was developed in order to take advantage of online surveying based on its ease of use and flexibility. Authors note that this application may be of particular value to researchers who are employing large sample sizes that are frequently needed for projects in which frequency analyses are required. The application uses a grid-based set of criteria to establish codes for participant-generated and open-ended data collected from online surveys and can be applied for scoring results from stem completion,-word or picture associations, and comparable purposes in which such participant-generated responses require categorization and coding. Authors advise that they use this application for their professional online surveying purpose in experimental psychology to examine substance abuse patterns derived from participant-generated responses to various verbal and nonverbal associative memory problems, but that the application is also appropriate for other research areas as well. Authors also note that the application helps improve survey reliability by providing a systematic approach to coding participant-generated responses as well as evaluating the quality of coding and interjudge reliability by researchers with little or no specific training for the purposes. Authors conclude that the coding application is helpful for survey research that uses open-ended responses in virtually any research area of interest.
Austin, T.M., Richter, R.R. & Reinking, M.F. (2008). A primer on Web surveys. Journal of Allied Health, 37(3), 180-181.
Authors report that survey research has become a widely accepted research methodology that has been facilitated through the introduction of computer-based and online survey methods. Authors also emphasize that although electronic survey methods are useful in a wide range of settings for a variety of purposes, they are not appropriate in every situation. Online surveys involve various technologies that have not been available (or required) for paper-and-pencil surveys and require special considerations involving their design, pilot testing, and response rates. Authors present the results of their empirical observations and professional experience in using Web-based surveys to illustrate some of the advantages and disadvantages of the approach, including security and confidentiality issues (they make the point that electronic surveys are particularly vulnerable to compromise and that survey data must be protected as the research progresses) as well as the special considerations that must be taken into account as they apply to this surveying approach. Authors also discuss issues such as sampling error, a "how-to" guide to writing survey questions for online media, and how to order questions to ensure that respondents answer accurately and faithfully. All in all, this was a very timely guide for researchers for identifying when Web-based surveys are most appropriate and what factors should be taken into account in the design, posting and analysis of online surveys.
Sarah's legal adviser under the previously described scenario, there a several questions I would like to ask my client before devising any potential defenses against Barry's charge of breach of contract. According to the facts presented by both parties, on Wednesday a conversation took place to negotiate the terms of a potential sale, with ownership of a refurbished laptop being transferred to Barry in exchange for $1,000 payment. On Wednesday, Sarah also informed Barry that her asking price was firm, and as a courtesy she also offered to withhold sale of the laptop until the end of the week if he was still interested. This proviso is central to Barry's eventual claim that a contract has been breached, because in his view this offer to reserve the laptop until Friday night at the very earliest was extended by Sarah and duly accepted by Barry, an agreement which would represent…

" In this case the part of Dozey was complete as he had recovered the cat, and was in the process of returning the cat to the owner Cindy. By the logic of the Carbolic smoke ball case the contract was complete and Cindy could not withdraw the offer and therefore was bound to pay the sum. Thus the revocation even in the newspaper may not have much significance because it would not have been complete against Dozey as per the Carlil case. Secondly in the instant case Cindy tells Dozey that the offer is withdrawn after he has performed his part of the offer. Therefore the revocation did not happen because the conditions of the offer have been fulfilled before revocation and hence Cindy would have to honour the offer.

Email Policy estrictions
espond to the following prompts:
Identify the employer's policy at issue.
A policy that prohibited the use of corporate email for personal/non-business purposes (Law Memo, 2017)
Determine why the policy was challenged.
The policy was enforced for union email activities but not for other non-business emails (e.g. baby announcements, etc.) (Law Memo, 2017).
Compare and contrast the General Counsel's and the employer-espondent's arguments
The plaintiff asserted that the enforcement of the policy was retaliation for union-organizing activities. The defense asserted that the enforcement was consistent with the policy. The judge actually agreed with the latter but came down against the employer because they were not consistent in enforcing the policy for EVEYONE that deviated from the policy, for whatever reason (Law Memo, 2017).

Two of the necessary conditions for the formation of a contract are offer and acceptance. Over the years, courts have faced a number of questions as to what, specifically, constitutes offer and acceptance. Issues relate to wording, timing and medium, among others. The advent of electronic communications, and its constant evolution, has opened the door to more grey areas that ultimately need to be resolved with respect to what constitutes offer and acceptance. A number of issues spring to mind -- is a text message sufficient to be deemed "in writing," is the shorthand in which many electronic communications are written valid for the formation of a legal contract, and what about electronic forms, which are essentially a one-way form of a communication? This paper will examine the case law that surrounds the evolving field of electronic communication, and how case law has dealt with modern methods of communication.

The Significance of Watson Human Care Theory in handling dying patients
It is imperative to integrate a psychosocial treatment strategy in handling dying patients. This is based on the knowledge that dying patients could have lost hope leading to depreciation of an illness. In any case, most of the acute illnesses could have been contained at the primary stage of development. Healing or ailing is primarily managed by the mind and not the techniques applied in the medical arena. This study is critical in proving the essentiality Jean Watson's theory of human caring. I will heavily relate to the study to respond to necessities of a dying patient. In particular, the discussion will analyze how the theory is significant in exploring the comfort levels required in the general treating and healing process.

It largely appears as though Jacob is experiencing signs of depression. There are a number of telltale signs which point to this assessment. One of these signs is he has recently experienced a life-altering event with the loss of his business. Such a loss is especially devastating for this individual because it was his sole source of income, which lends a degree of pragmatism to the sort of anxiety which can rapidly lead to depression (Cadigan and Skinner, 2015, p.293). This notion is compounded by the reality that he seems somewhat unilateral in his interests, claiming his former business was his sole hobby. As such, it appears he feels he has nothing else to turn to in such a time, which might heighten any feelings of depression. It is important to realize such perceptions on his part are likely aggravated by the frustration of being in the…
Additionally, no terms of the contract can be changed, including in terms of new clauses being added.
3. A bilateral contract involves two parties that exchange a set of promises that determine the rights and obligations of each of the parties. As such, each of the parties will have a set of promises that they oblige to undertake if the contract is enforced. There are also returns for each of the parties in this type of contract.
A unilateral contract is the type of agreement where only one of the parties of the contract promises to fulfill a set of obligations to the other party. Beyond this, one of the main differences to a bilateral contract is that the acceptance does not need to necessarily be communicated to the offeror, but can rather be implied through the party completing the promise made in the agreement.

contract is a legally enforceable promise that allows commerce to flow smoothly throughout society. ithout contracts, businesses and consumers would be embroiled in constant disputes with potential for fraud and frequent misunderstandings but the fact that contracts are available does not eliminate disputes and resulting litigation. The courts are full of cases involving transactions between parties that have been formalized by the existence of a contract but the existence of a contract, or what the parties believed was a contract, does not ensure that matters will progress without problems.
Although contracts are in their simplest form promises there are elements that must be contained in contracts that distinguish them from simple promises. All contracts must contain: 1) an offer; 2) an acceptance; and 3) consideration. In a perfect world, every contract would have clearly identifiable offer, acceptance and consideration but in reality this is not always possible and the terms…

Diversity
What is diversity?
Diversity refers to the differences that occur among people and groups which should be taken into account in the healthcare setting. In the healthcare environment diversity and the recognition of diversity is an extremely important concept as it deals with recognizing the needs and requirements of the individual, as well as the needs and requirements of different groups. Furthermore, diversity is seen in a positive light in the healthcare context, as understanding diversity means that the healthcare professional is in a better position to understand the needs of the patient and to improve the treatment of people from different groups or areas of society.
Discuss and give examples of how people are diverse.
People can be diverse in various ways. One could refer to gender differences, as well as cultural and ethnic diversities. Understanding these differences becomes important in dealing with specific problems. One can also talk about differences…

new convention on the rights of domestic workers be enforced?
This paper is a treatise on the topic of the new Convention on Decent Work for Domestic Workers, established by the International Labour Organization (ILO) in Geneva, Switzerland on June 16, 2011 as ILO Convention 189. The convention may alternately be referred to in literature as the Domestic Workers Convention, 2011 (No. 189). The convention will hereafter be referred to in this document as C189. We will outline and discuss salient issues and challenges surrounding the acceptance and enforcement of C189, a landmark convention in the eyes of many. Although indisputably necessary and essential, C189 has nevertheless been controversial in its content and interpretation, and will continue to be so in upcoming years. C189 will require not only international cooperation for its success, but also the development and ratification of new and advanced provisions in international law. The challenges inherent…

tomorrow / Bright before us / Like a flame. (Alain Locke, "Enter the New Negro," 1925)
rom the 1920's Alain Leroy Locke has been known as a prominent figure in the Harlem Renaissance. Through his writings, his actions and his education, Locke worked to educate not only White America, but also the Negro, about the beauty of the Negro heritage. He emphasized the idea that no single culture is more important than another. Yet it was also important to give sufficient attention to one's own culture and its beauty. This was Locke's philosophy of cultural pluralism.
The White heritage has enjoyed prominence for a large part of American history. During the colonization period, the Whites have emphasized their own superiority while at the same time ensuring that people of other ethnic heritages knew in no uncertain terms their own inferiority. This gave rise to a nearly monocultural America, where all other…
Furthermore Locke's writings are lauded for their cultural and historical importance rather than their literary style. Being very prominent in educational and artistic circles I find this hard to believe. Certainly a man who has been educated in the highest of quality schools should be able to produce something of purely literary merit.
Despite these issues which are admittedly a matter of opinion, it is very significant that Locke's influence extends to modern literary circles in this way. Locke's influence in the areas of education, culture and empowerment also remain to this day in terms of recognized Black culture and the promotion of cultural pluralism. The ALLS has been officially recognized by the American Philosophical Association in a letter from Secretary-Treasurer, William Mann, on November 26, 1997.
Locke's influence thus reaches far beyond his lifespan in order to not only empower and inspire, but also to enlighten and to entertain. Locke was the epitome of the New Negro.
Programming Management
Testing
Code
asically, systems and applications are being developed to facilitate the traditional manual process. It is essential, therefore, that they must conform in the designed functionalities and specifications to effectively serve their purpose. Code testing is a critical element to this procedure to ensure that systems function well and that they meet user-requirements.
Manual
Manual code testing involves evaluation and assessment of program codes through manual process, whether the functionalities match those listed in the detailed design. In this test process, a series of codes are designed, developed, and embedded within the actual software or system codes to test the program's vulnerability. Normally, iterations are done to extensively test and validate code units. Following are some components of a manual code test process that can be expected in this section of a procedural manual.

Indeed, arguably he is playing a little loose with the terms here, for persuasion, while it may be based on logic, is rarely simply logic. Rather it is logic combined with at least a coating of emotion.
In the following passage toward the end of his speech Obama uses language that I believe to be persuasive in a way in which Aristotle would approve, for Obama is using facts to build a case for his point-of-view rather than simply trading in emotion that he has called up for the occasion: This is not sophistry.

A teenager's ability to thrive in his/her social circle may have more to do with innate qualities such as companionship than looks or talents, attributes that are commonly associated with popularity.
Whereas peer relationships can clearly have a positive role in social development, there are certain types of peer orientation that can also be detrimental. There are some teenagers who are extremely orientated to their peers to the extent that they break parents' rules, sacrifice school performance, undermine their talents, and even hide positive areas of their lives in order to maintain their peer relationships (uligni et al., 2001). This is the type of peer orientation that parents commonly object to and for good reason. Extremely peer oriented teenagers often feel that they have to stand out and hence seek problem behavior-oriented peer groups such as those that regularly skip class, abuse alcohol, and use drugs (uligni et al., 2001).…
For parents who may be concerned about their child's troubled peer relationships or peer orientation, much can be learned from these documented evidences on child social development. Parents must understand that problems such as bullying, deviant behavior, association with problematic peer groups, and the like are often processes that evolve over time and involve an interplay between many early risk and protective factors (Schwartz, et al. 2000, Fuligni et al., 2001). While some of these factors are temperamental in nature (e.g. non-assertiveness, submissiveness), many of them are also parental control related. For instance there is evidence to suggest that maternal over-protectiveness can be a factor in the bullying of submissive and passive victims (Olweus, 1993 in Schwartz et al., 2000). Similarly, excessive parental control during the teenage years can drive adolescents to place greater importance on their peer relationships rather than their parents (Deveraux, 1970, in Fuligni et al., 2001). On the other hand, a complete lack of parental control or support can also lead adolescents to seek more advice from their peers and thus be more influenced by them rather than their parents (Bonfrenbenner, 1967; Condry and Simon, 1974; and Steinberg, 1987; in Fuligni et al., 2001). Hence, parents must try to exert a developmentally appropriate level of control on their children and learn to adjust their relationship with them to accommodate their child's increasing level of maturity.
Parents should encourage their children to cultivate friendships within peer groups that are achievement oriented, wherever they may be found - in school, a sports or hobby club, church, work, etc. Studies show that association with healthy peer groups such as these are less likely to result in children showing problem behavior and low academic achievements in the latter adolescent years (Fuligni et al., 2001). Parents should also try to promote closeness in the family (e.g. By having meals or doing simple things together). Family cohesion has been shown to buffer the effects on adolescents who may be involved with deviant peers and is hence a protective factor for possible problematic behavior (Fuligni et al., 2001).
This paper has described the many roles that friendships and peer groups can play in a child's social development. The impact of these relationships is especially significant during the volatile teenage years, a critical transitional stage when children have to renegotiate relationships with their parents while at the same time seek acceptance from their peers. Friendships can either make or break a child and the important role of parents lies in giving them age-appropriate freedom and control; providing a supportive, cohesive home environment; and encouraging their children to associate with peer groups that have a positive influence.
There are many estern doctors who do not accept the traditional views and system of acupuncture but they have realized that it has certain effective aspects. estern doctors have therefore adapted acupuncture and used it as a way of regulating the nervous as well as the endocrine systems. There has also been widespread recognition of the painkilling aspects of acupuncture. hile there is still a general resistance to the deeper implications and world -view that acupuncture represents, yet there is no doubt that it is having an increasing impact on estern forms of medicine and healing praxis.

771). His arguments center on the public responsibilities of marriage. He writes, "This is true because legal marriage is a public institution, created by law to promote public policy and to further social interests" (Wardle, 2001, p. 771). He goes on to state that traditional marriages foster "childrearing, economic stability, and channel sexual behavior" (Wardle, 2001, p. 771). Unfortunately, these arguments seem outmoded and irrational. If this is the purpose of traditional marriage, then clearly, hundreds of thousands of couples are not engaged in socially responsible marriages. They channel their sexual behavior outside the marriage, they are economically unsound, and they do not raise children. Thus, traditional marriage is not supporting society as Wardle sees it, and perhaps the entire institution should be overhauled. Wardle's arguments are illogical at best, and do not effectively argue against same-sex unions at all.

Toleration is generally viewed as the ability to accept the beliefs and ideas of others. In American society toleration is generally seen as a positive characteristic. It incorporates both having empathy for others and for having the ability to accept the views of others without necessarily agreeing with them or understanding them. Inclusive of the idea of toleration, is the fact that the ideas are not agreed with. If a person is to tolerate an idea, they must first feel negatively about that idea. The idea of tolerance may be good, but its effect in modern society is a negative one. Bradford Smith describes tolerance as something that inhibits people, describing it as a form of self-righteousness where it should instead adopt the ideas of acceptance, concern and understanding. The struggle is in the very nature of tolerance itself. It requires people to accept things they do not understand or…
Because our programs have such great diversity, we could literally become aware of many new cultures. I think that the parents could also do more volunteer work with or for the school. Classroom aides or lunch aids could help children see other' at work and in the school setting. But the most important, is that the schools address the lack of diversity in the text books. For example, we teach almost nothing about Muslim or Middle Eastern cultural perspectives in our curriculum. We are not trying to convert students, only make them more aware.
In addition, I am aware of some situational discrimination outside of the school. I have witnessed it myself and I must admit that I was quite surprised by it. Although the article was about educational issues, I can attest that our Arab and practicing Muslims students as well as others of Middle Eastern descendent have been…

The product will meet the International Federation of Organic Agriculture Movements (IFOAM), European Union, and other specific certification requirements, so may be exported. The Internet will be considered as a target for purchases, but will mainly be used for advertising the product. Mapco stores will be the exclusive client of this product, and will be the outlet to other organic health food agencies that may elect to sponsor sales of this product, as well.
The increased product range will depend upon acceptance by Mapco clientele and consumers, with sampling in other areas and acceptance in the health food market.
Success in product marketing starts by finding the point of difference - the cluster of strengths and selling points that are unique to this product alone. The…

Kidnapping, extortion and detention are real dangers for businesses that operate both overseas and in domestic markets. Top management of these firms often overlooks these things by saying that it will never happen to us. They seem to not understand how much damage it can do to a business. "With more than 1,000 annual kidnappings of business professionals and executives all around the world and number of terrorist's attacks, such policies is an absolute necessity in the eye of life and health insurance professionals who travels internationally" (Gordon, 2009). Kidnap and ansom insurance policies give a cushion to a business with regard to independent investigations, collaborations, arrangement and delivery of funds, and number of other services pivotal to a safe, speedy and satisfactory resolution. Any business of any size can be a target for extortion threats against them or their employees. People are inclined to think business extortion and kidnapping…

contract have been well established over the course of time and have remained constant during that time. Traditionally, contracts have been defined as consisting of an offer and acceptance supported by consideration but there other elements that must accompany these basic elements in order for a contract to be formed and enforceable (Perillo, 2009).
In contractual parlance, an offer is the manifestation of a party to enter into a bargain so that another party develops an understanding that his assent is being invited. Such action is the initial step in the formation of a contract and no other element can be satisfied until an offer is made. The second step in the formation of a contract is the manifestation of the acceptance. Acceptance can be relayed in any manner sufficient to advise the maker of the offer that he assents to the terms of the offer. Any attempt by the…

Multicultural Children's Books -- an Analysis
Children's literature more accurately reflects the many histories that construct nations such as the United States. The perspectives of children's books should be included read for this week's session for continued analysis and interpretation. Multicultural perspectives were excluded in the past for several reasons. One reason is that the cultural perspective that had the most value and was valued at all, was the white American male perspective. This is the perspective of the colonizer. It is typically those who colonize that write the history books and decide which stories are told (and how), and which stories are excluded from memory. The book of focus for the purposes of this paper is Cheyenne Again, about a young Native American boy who is taken from his tribal lands and culture, and very much forced into the lifestyle…

Nursing
Bar code medication administration (BCMA) is one of the keys to minimizing medical errors in a manner consistent with evidence-based practice (Poon et al., 2010). However, universal embrace and utilization of BCMA remains stagnant. easons for resisting the transition to BCMA include nurse perceptions. Holden, Brown, Scanlon, & Tzion-Karsh (2012), for instance, found nurses reporting low perceived usefulness of BCMA in spite of the wealth of evidence supporting the technology. Perceived ease of use of BCMA was moderate, suggesting that it is mainly attitude factors preventing nurses from implementing BCMA in their institutions. When perceptions of the usefulness of BCMA increase, then compliance with BCMA standards can become more widespread. Any program that attempts to increase the utilization of BCMA must focus first on human factors including attitudes. This requires that all nurse leaders, as well as nurse educators, prepare advance practice nurses for using BCMA as a matter of…

CPA Solutions has made the decision to relocate and position one of its proficient and capable personnel, Sophia Tannis, to their offices in Europe. This approach and move is purposed to connect the company's corporate headquarters with the local personnel in Europe in addition to the general public. To Tannis, this is a significant point in her career in which she can either progress or see a downfall. However, this major move does not come easy and is filled with significant challenges (Blanchard, 2013). One of these challenges is that the personnel in Europe are hesitant in embracing the American culture, approaches and policies. Therefore, in their perspective, Tannis signifies the global headquarter and is an outsider. Another major challenge that Tannis faces is that she is moving to a position and environment that is male dominated. The organizational culture is also a barrier to Tannis' endeavors, as it does…
Jen is a 19-year-old female of mixed ethnic background. When asked what her therapeutic goals are, Jen states that she wants to "get over" the physical abuse she was subjected to her from her mother's ex-husband (her stepfather). In the third therapy session with Jen, she abruptly claims that she may not be continuing with therapy because she is just "therapist shopping."
Also in this session, Jen mentioned for the first time that she works as an exotic dancer. She asks with a belligerent tone, "You don't have a problem with that, do you?" Even though there was no response, Jen quickly defends herself, saying, "I love my work. I make so much money. There is nothing else I can do to make this much money. All my friends work harder than I do but they make less than me! I mean, I not only pull in what I make from…
Dawn's presenting problems, such as a sleep-related disorder and anxiety symptoms, it is possible that she may be diagnosed with a mild depression, or to use the DSM-V code, F32.0 Major depressive disorder, single episode, mild. Measured on the Ham-D scale of depression, Dawn's score will likely fall between 9-12 (Weissman, Markovitz & Klerman, 2007). However, monitoring Dawn over time will be necessary to see if the depression is recurrent.
It is unclear when her "feeling stressed" about her grades began, exactly, or when her sleep patterns started to be disrupted. Therefore, if a DSM-V diagnosis is necessary, the F32.0 diagnosis is the most sensible for now. As Hayes, Pistorello & Levin (2012) also point out, the DSM diagnoses are limited in applicability and accuracy. They have "failed to give rise to functional diagnostic entities, which is a major goal of syndromal diagnosis," (p. 976). The process of diagnosis also occurs…
By connecting the awarding of a peace prize with the concerns of a world in which terrorism has become a constant threat, Obama makes clear the exigency of his message when he says: "I do not bring with me today a definitive solution to the problems of war."
Nobel laureates are given few formal constraints in terms of their responses but Obama faced the more general constraints of trying to meet very high expectations and the conflicting expectations of the peoples of different nations. I believe that he did a good -- though not perfect -- job in meeting these differing expectations, and so crafted a speech that served as a fitting response to the occasion.
Whether or not one believes that Obama achieved the Aristotelian concept of ethos -- the ability to make a credible ethical appeal -- depends probably more on one's own politics than the speech itself. I…
Linguistic analyses of conversational patterns indicate that most pauses can be predicted by linguistic structures, such as clause or sentence breaks" (Levitt, 334) by eliminating some of the non-verbal factors that may tend to undermine these silences, I would find that the interviewee was far more comfortable with the nature of the interview and its opportunity for a free and informal discussion relating to treatment experience, personal history and current disposition.
3. Conclusion
The helping model, according the research which was conducted in preparation for and in light of Mr. Smith's situation, would be further illuminated by the interview. Here, firsthand interaction illustrated that individuals who have undergone such institutional experiences are sometimes eager to share details and feelings directly related thereto. The way that Mr. Smith opted to open up would be especially revealing in verifying the value of allowing one's self to fully accept and understanding the nature of…
