In this outline, I would point out the company lose business if they do not take fault in this situation. People like to see a honest and humble company. If they only see a ruthless side, it could turn into a great financial risk and loss. They need to agree to a settlement with the persons involved with the lawsuit so that the customers can see a company that cares.
Companies must research a program prior to implementation to ensure it will be successful, and to determine any potential failures. Companies realize a successful process at another company does not guarantee the program will work in every business model. Research is a diligent and systematic inquiry or investigation into a subject in order to discover or revise facts, theories or applications. Benchmarking is a way to compare how one company does business with another in the same industry. Benchmarking occurs when a company wishes to develop new plans and ideas and wishes to see how other like companies has been successful. Benchmarking requires many hours of research to determine the risks associated with implementing the processes and removes the stigma of "it has always been done this way" while allowing for a variation to problem solving. It uses a review of best practices and though costly, the benefits will outweigh the costs. By using benchmarking practices, companies can implement new and improved business practices and develop plans which will help them succeed.
Employers must consult with employees about OHS matters, so that employees can contribute to decisions affecting their health, safety and welfare. The Act provides for occupational health and safety representatives to be elected when requested by an employee. OHS Committees can be established in workplaces of 20 or more where the majority of employees request it. Other consultation arrangements can be agreed to between the employer and employees. The OHS Regulation details obligations established in the Act in relation to consultation. Further guidance is provided by a WorkCover Code of Practice which outlines steps that can be taken to set up consultation arrangements in accordance with the Act, and the application of the powers and functions of representatives and committees (occupational health and safety law 2007).
In other countries, checks and balances seem foreign due to their weak systems. The following is an example.
In Kenya and other countries with weak legislatures, the presidential contest is a winner-take-all affair. The Luo know that they cannot hope to constrain President Kibaki with the checks and balances to be found in a system with a powerful parliament. Instead, they face a frustrating choice between subordination to the president and violently contesting his rule in the streets. The Kikuyu, Kibaki's tribe, know that they cannot relinquish the presidency peacefully without forfeiting control over policy and patronage. Tragically, in the presidential election, everything seems to be at stake (Checks and balances key to avoiding civil conflict 2008).
There are many down falls of a free economy. and, with a free economy, there is free trade, which could be a downside.
