His goal is to retain twenty-five employees within the first year. To develop this compliance plan, my team will research applicable employment laws in Austin, Texas.

The Texas Payday Law

The Texas Payday Law covers all Texas business entities regardless of size, as well as public employers such as the state, federal government, and political subdivisions of the state. The types of payments covered by this law include compensation for rendered services, bonuses and commissions payable under a written agreement between the parties, and certain fringe benefits due under such an agreement.

In the event of a violation, a fine of one thousand dollars is charged. Employers are required to post notices about paycheck distribution timing in a conspicuous location. The law applies to all paycheck deductions except payroll taxes, court-ordered deductions, and garnishments required by law (Reynolds, 2007). Written authorization must be obtained from the employee before any such deduction is made. The organization must also maintain a separate policy on deductions and overpayments, and employees must acknowledge that policy in writing.

The Texas Workers' Compensation Act

Texas workers' compensation systems replace wages for employees who miss work due to on-the-job injuries. If an employer opts out of the system, the employee is free to sue for negligence, and there is no limit on collection if negligence is proven (Sullivan, 1988). However, employers who opt out lose important common-law defenses.

Employers are required to post all new notices related to medical care in the workplace. The workers' compensation insurance carrier must be notified within eight days of learning about any work-related death, any injury requiring at least one day off, or any work-related disease contracted by an employee. Employers must also establish an alcohol and drug-screening procedure in order to benefit from the intoxication presumption. HR professionals should coordinate with the insurance carrier and its attorneys regarding any reasonable accommodations and unpaid leave — such as intermittent leave or light-duty work — since employees injured on the job may also have a serious medical condition covered under the Family and Medical Leave Act (FMLA) or may qualify as disabled under the Americans with Disabilities Act (ADA).
