Private Investigator Ethics: Code of Conduct and Dilemmas

~7 min read 6 sections Ethics · Professional Ethics
Abstract

This paper examines the occupation of private detectives and investigators through the lens of professional ethics. It begins with an overview of job duties drawn from the Bureau of Labor Statistics, covering surveillance, background checks, and cybercrime investigation. The paper then analyzes the code of ethics established by the Private Investigators Association of Virginia as a representative state-level standard, highlighting expectations around legality, non-discrimination, fee transparency, and employee conduct. Finally, it identifies two significant ethical dilemmas specific to the profession: pressure from clients to conduct illegal surveillance, and the temptation to produce biased reports or charge undisclosed fees in order to protect referral relationships.

What makes this paper effective

  • The paper grounds its ethical analysis in a real, named professional code — the Private Investigators Association of Virginia — rather than speaking in abstractions, giving the argument concrete authority.
  • It connects legal consequences directly to ethical violations, showing how illegal evidence collection harms not just the investigator but also victims who are denied justice.
  • The two ethical dilemmas are logically sequenced: one involves external client pressure to break the law, and the other involves internal temptations around reporting and billing, covering both relational and procedural integrity.

Key academic technique demonstrated

The paper demonstrates applied ethical analysis by moving from a general occupational description to a specific professional code and then to concrete dilemmas. This structure — describe the role, present the standard, test the standard against real-world pressure — is a reliable framework for professional ethics writing at the undergraduate level.

Structure breakdown

The paper opens with a brief introduction scoping its focus, then provides an occupational overview using a government source (BLS). A dedicated ethics section presents the Virginia code verbatim before interpreting it. Two separate analytical paragraphs examine specific ethical dilemmas, and a short conclusion summarizes the findings. The structure is straightforward and well-suited to the topic's scope.

Introduction

Occupations in the field of criminal justice have long attracted widespread interest. The field encompasses many different roles, including lawyers, police officers, and probation officers. For the purposes of this discussion, the focus is on private detectives and investigators. The discussion covers the occupation itself and the code of ethics associated with it. In addition, the paper explores unique ethical standards for the profession and identifies at least two examples of potential ethical dilemmas specific to this line of work that the code of ethics is designed to discourage.

Job Description

According to the occupational handbook published by the Bureau of Labor Statistics (BLS), private detectives and investigators are responsible for carrying out a wide range of services. Depending on the type of crime that has been committed, private detectives might be involved in surveillance activities that may include following an individual or tracking communications (Private Detectives and Investigators, n.d.). In some cases, they may also conduct background checks or interviews. Private detectives and investigators may additionally be responsible for investigating cybercrimes such as identity theft or electronic harassment. The work they perform serves to benefit police officers, lawyers, and victims of crime (Private Detectives and Investigators, n.d.). Private detectives are also utilized in many different arenas, including corporations, celebrity protection, and pre-employment verification (Private Detectives and Investigators, n.d.).

A typical day in the life of a private investigator may include highly irregular hours, particularly when physical surveillance is required (Private Detectives and Investigators, n.d.). An investigator may need to begin work early in the morning to follow a subject or conduct physical surveillance. Some private detectives work alone, while others work for large corporations or own their own agencies where several investigators collaborate (Private Detectives and Investigators, n.d.). If the detective is conducting electronic surveillance, a significant portion of the workday may be spent in the office. Nighttime surveillance is also a common part of the job. According to the BLS, this type of work can be both dangerous and stressful on a daily basis.

Code of Ethics for Private Investigators

Overall, private detectives and investigators are expected to perform whatever tasks a client requests within the bounds of the law and their professional code of ethics. Because many private detectives and investigators are self-employed, each state maintains a code of ethics that investigators are expected to follow. For instance, individuals who are members of the Private Investigators Association of Virginia make a pledge to honor the following code of ethics:

  • To carry out services in a manner that is honest, sincere, and moral when dealing with clients (Code of Ethics).
  • To ensure that clients have the utmost confidence in the investigator and to deal justly regardless of race, ethnicity, religion, or economic status (Code of Ethics).
  • To conduct all investigations within the bounds of legality, morality, and professional ethics.
  • To counsel clients in opposition to any illegal or unethical actions.
  • To explain upfront all fees associated with the services to be conducted and to produce a report that is factual.
  • To preserve a professional reputation while also preserving the reputations of fellow investigators and professional associates (Code of Ethics).
  • To support the professional goals of the Private Investigators Association of Virginia, including contributing to improved community relations (Code of Ethics).
  • To ensure that all employees abide by this code of ethics (Code of Ethics).

The code of ethics established by the state of Virginia is similar to those that other states have in place for private investigators. In essence, private detectives and investigators are expected to obey the law as they carry out their investigations. They are not to discriminate against clients or charge fees that have not been discussed with the client in advance. Additionally, private investigators who own agencies are responsible for ensuring that their employees conduct themselves in a manner consistent with the code of ethics.
